When purchasing a yacht, many prospective owners focus on the yacht itself, only to realise later that the chosen flag affects almost every aspect of ownership and operation. The flag is not just a registration number on the stern, it is effectively the yacht's "nationality" and determines: -
The choice of flag of a yacht would ideally be made before signing the final purchase documents. A change in flag when building has already started or on completion of a second-hand yacht acquisition will definitely involve extra costs, surveys, documentation, re-certification and administrative delays which could be avoided through proper advance planning.
The intended use of a yacht by its prospective owner frequently determines the choice of flag state and whether the yacht is registered as a commercial or pleasure vessel.
When the yacht will be used solely by the owner, family and friends, a private registration may be appropriate because the owner generally has simpler compliance obligations, lower certification requirements, greater operational flexibility and reduced crew certification requirements.
If the owner intends to charter the yacht and earn income from its operation, which would help cover some of the yacht’s running costs, the yacht would need to be registered as a commercial yacht, which would involve complying with commercial coding requirements (including the need for additional safety equipment and more stringent crew requirements) in order to have the yacht commercially certified, as well as ensuring fiscal compliance in the different jurisdictions where the yacht will be operated.

One of Malta's strengths is its dedicated regulatory framework for yachts. Depending on the use, size and area of navigation of the yacht, different rules apply.
The 2024 Small Commercial Yacht Code has been designed for yachts less than 24m in load line length, also carrying up to twelve passengers, but provides a more proportionate regulatory regime that reflects the lower complexity and risk profile of smaller vessels, whilst maintaining high safety standards.
The 2025 Commercial Yacht Code applies to commercial yachts over 24m in load line length carrying up to twelve passengers. The Code sets safety & manning requirements, construction standards, survey obligations and operational procedures, which are distinct from requirements for large merchant ships.
Private yachts are not required to meet the same standards that apply to commercial yachts under the above-mentioned Codes. The Malta Ship Registry has introduced non-mandatory Safety Guidelines for Pleasure Yachts under 24 metres in hull length (as defined by ISO 8666). Effective since 1 June 2026, the Guidelines are a voluntary and flexible set of recommendations, designed to support yacht owners while encouraging high standards of seamanship, maintenance, and responsible yacht operation.
For pleasure yachts exceeding 24 metres in length, the regulatory framework is primarily derived from the Merchant Shipping Act (Chapter 234 of the Laws of Malta), together with applicable subsidiary legislation governing registration, safety and navigation. Depending on the yacht's size, tonnage and navigational area, compliance may also be required with relevant international conventions, including COLREGs, MARPOL, SOLAS and applicable radio communication requirements. All pleasure yachts that are in class must meet the rules and standards imposed by their classification society.
Malta evidently offers one of the most attractive flag solutions for both pleasure and commercial yachts. It is an internationally respected register, having an EU legal framework, strong mortgagee protection, an efficient administration, and a yacht-specific regulatory regime that is well understood by owners, managers, brokers and financiers. The choice as to which flag a yacht should fly is often one of the most significant legal and operational decisions in the ownership process. It impacts far more than registration alone, extending to financing, taxation, crewing, regulatory compliance and navigational freedom. When these considerations are assessed holistically, it is easy to understand why Malta continues to be the chosen flag for a number of yacht owners and industry stakeholders worldwide.
