At first glance, Malta’s new Equal Pay (Transparency and Reporting) Regulations, 2026 may feel like another layer of compliance for employers. 

But viewed differently, they may offer something far more valuable: clarity and freedom. 

Equal pay for work of equal value is not new to Maltese law. It has formed part of our legal framework for over than two decades. What has often been missing, however, is a clear and practical way to assess what gives work its value and how pay should be structured around that assessment. 

The new Regulations help fill that gap. These Regulations require pay structures to be capable of showing whether workers are in a comparable situation by reference to objective, gender-neutral criteria including skills, effort, responsibility, working conditions and other relevant factors, including soft skills. 

That is important not only for addressing the gender pay gap, but also for employers who want to build fair, defensible and transparent pay systems, beyond the question of gender pay gaps and claims for gender discrimination. 

In that sense, transparency need not be seen only as a constraint. If properly harnessed, it gives employers a stronger basis on which to not only explain pay differences but to design pay grades and reward roles according to objective factors that are relevant to the work actually performed and the qualities which go into the performance of that work.  

The opportunity – indeed, the invitation -  is therefore not merely to comply, but to use transparency as a tool for better job and pay architecture, clearer internal decision-making and greater trust in the workplace ultimately resulting in higher engagement, psychological safety and lower employee turnover.  

Transparency, after all, breeds trust and trust is the cornerstone of any relationship – including the employment relationship.
